I just spent the last 8 months working with a team of caring, compassionate, relatable women for my personal injury claim. Brief background: I was hit by a car while riding my bike to work. The driver pulled out of a parallel parking space without looking and was completely at fault. Oakland Vehicle vs. Bicyclist Crash at 27th Street and West Street

What would you do if you were riding your bicycle and a car smashed into you? Or what if you were driving your vehicle and a cyclist seemed to come out of nowhere and hit you?

These crashes can be quite contentious and the two parties rarely agree about what happened. Here’s a vehicle vs. cyclist accident that occurred right here in Oakland, California. According to the traffic collision report from the California Highway Police, two officers arrived at an accident at 27th Street and West Street just after 10 a.m. on a Wednesday in January. The weather was clear.

At the accident scene, a bicyclist was laying on the ground in the lane of traffic. He appeared to be conscious, breathing, and not bleeding. The driver of a car that was also involved in the accident was nearby. The officers interviewed both people plus a witness.

The car’s driver told the officers she had been traveling south on West Street and had a green light to enter the intersection. She said she heard a thump on the right rear side of her vehicle but didn’t see anything. She continued driving, then turned around and came back.

The cyclist said he was traveling north on West Street along the right side of the roadway, then entered the intersection on a green light. He said he collided with the car when it made a left turn and cut him off. The witness stated that she was on the southwest corner of 27th Street and West Street when she observed the car collide with the cyclist. She said she couldn’t tell which way the cyclist had been traveling but saw him fall to the ground.

After taking these statements and ensuring the traffic signal was functioning correctly, the police officer cited the driver who hit the cyclist with a violation under California Vehicle Code 21801(A), failure to yield when making a left turn.

Two Vehicles Collide at 14th and Poplar in Oakland

At about 4 p.m. on an autumn Tuesday afternoon, a white Volvo S40 and a black Toyota Camry collided at an Oakland intersection. When a police officer arrived, both cars were sitting in the roadway on 14th Street near the intersection with Poplar Street.

The officer observed that the Volvo had sustained damage to the right rear door/axle area and was about to be towed away. He interviewed the Volvo’s driver, who said he was uninjured after the accident. The Volvo driver reported that he had been making a left turn from 14th Street onto Poplar Street when the Toyota struck the right rear of his car. This caused his car to swing from northbound to eastbound and his airbags deployed.

The officer interviewed the Toyota driver, a woman whose baby was inside the car in a car seat at the time of the accident. She said she had been westbound on 14th Street when the Volvo tried to make a quick left turn in front of her. She slammed on her brakes but couldn’t stop in time and hit the Volvo.

After the accident, the mother told the officer she had pain in her right arm but declined medical attention. The baby appeared to be calm, but the mother wanted the baby to go to the hospital to be checked for injuries. The Toyota was towed away at the officer’s instruction because it was impeding traffic.

The Volvo driver was cited under California Vehicle Code 21801(a) for failure to yield properly. The officer stated that it appears that the Volvo driver did not yield to the Toyota driver when making a left turn, causing the collision.

Uber Driver Collides with Pickup Truck at Busy Oakland Intersection

Here’s an example of a California traffic accident where each driver tells a very different version of what happened. The crash occurred in Oakland at the intersection of West Grand Avenue and Mandela Parkway on a Sunday in June just before 8 p.m.

The driver of the first vehicle, a grey 2008 Toyota Tundra pickup truck, told the investigating police officer that he was traveling west on Grand at about 25 to 30 miles per hour. As he approached the intersection with Mandela Parkway, he had a yellow light.

He said as he passed through the intersection, he hit a blue 2016 Mazda 6 that was turning in front of him. However, the Mazda driver’s testimony given to the police was vastly different.

The Mazda driver, who was driving for Uber at the time of the accident, said he was headed south on Mandela at about 35 to 40 miles per hour and entered the intersection with Grand on a green light. Then he felt the pickup truck impact his car hard on the rear driver’s side.

Both vehicles sustained moderate to major damage and were towed from the scene. The pickup truck driver told the officer he was uninjured in the crash and the Mazda driver said he felt pain in his neck and chest. 

After investigating the accident, the officer concluded that it was caused by a failure to stop at a red light but it was unknown which driver failed to stop. The officer concluded the report by saying, “Unable to determine party at fault for collision.”
