Let's Get You Back on Your Feet

Here's What to Do in the Event of an Oakland Pedestrian Accident

Chances are you won’t be thinking like yourself immediately after your accident.

And that's perfectly normal.

A crash is traumatic and disrupts your brain as much as it does your body.

The first thing you should do immediately after any accident is seek medical attention—regardless of your ability to pay.

And the next thing you should do is consider contacting a qualified Oakland personal injury attorney.

Because time is not on your side. And here's why:

With every passing day, the likelihood of receiving a financial settlement that’s fair and just decreases.

Evidence can get misplaced, reports can get lost, and eyewitnesses can forget details.

And to make matters worse, insurance adjusters will be contacting you within days  -- maybe even hours -- of your accident, to pressure you into accepting settlements that are far below what you may actually be entitled to.

Sure, it's their job . . . but that doesn’t make it any easier to swallow.

And to add insult to injury, anything you say to those insurance adjusters can be used against you to decrease your eventual settlement. So you need to be well prepared when speaking to them and a personal injury attorney can help in that regard.

And that's just one of the reasons you should consider contacting a qualified Oakland pedestrian accident attorney.

Know Your Rights

You're Not at Fault for Pedestrian Accidents: Oakland Drivers Are

In most every pedestrian accident in Oakland, negligent, reckless or careless drivers are at fault.

And there are three main contributing factors when pedestrians and cars collide.

Speeding

Speed is the top contributing factor to all pedestrian accidents in Oakland. And it’s responsible for most fatal accidents.

Why?

Because speed adds force. And force intensifies the impact.

A pedestrian has a 90% chance of surviving being struck by a car if that car is travelling 23 MPH or less.

And that chance for survival drops for every mile per hour above that.

At 50 MPH 75% of victims will die.

Alcohol

We all know that alcohol makes drivers more dangerous. It can impair a driver's reaction time, reduce their ability to see pedestrians, and prevent them from making smart decisions.

Many impaired drivers involved in pedestrian accidents in Oakland face jail time.

However, victims can seek civil penalties and financial settlements regardless of whether the at fault driver is arrested or not.

Failure to Yield

Pedestrians have a right to be on the road too, and failure to yield for a pedestrian is one of the most common causes of pedestrian accidents in Oakland.

Many drivers fail to react in time, or simply don't see victims before it's too late.

Are You Prepared?

The High Cost a Personal Injury Accident in Oakland

In addition to the pain and suffering, a pedestrian accident in Oakland can take a tremendous bite out of your finances.

Many times, such devastating crashes leave victims out of work for weeks or months at a time.

In Oakland:

  • An ambulance ride can cost between $1,300 and $2,000 or more.
  • An ER visit can run between $600 and $5,000, without any special services.
  • A single day as inpatient at Alameda County Medical Center costs, on average, $12,000.
  • And procedure with an orthopedic surgeon runs upwards of $10,000.

Imagine trying to cover that cost without health insurance, or without a fair settlement from the at fault party's insurance company.

It could literally cripple a family for years, even after the victim was able to get back to work.

Get Back on Your Feet

The Quickest Path to Financial Recovery

Seeking a fair settlement is the quickest path to financial recovery available to pedestrian accident victims in Oakland.

Why?

Because insurance companies are more likely to pay a fair settlement without a fight when a pedestrian is involved.

This means:

  • Less time haggling over the victim's reward.
  • A smaller chance of escalating your case to a California court.
  • And less time you will be dependent on your savings -- if you have any.

An experienced Oakland pedestrian accident attorney will fight for every penny you deserve. They won't be out to line their pockets, or risk everything in court for an astronomical settlement.

Instead, they'll work hard to get honest people like you the financial break they need to they can focus on their recovery.

OAKLAND PEDESTRIAN ACCIDENT | GREAT RESULT DESPITE LOW POLICY LIMITS OF $50K

A 34 year old music teacher was an Oakland pedestrian crossing the street in a crosswalk when a driver failed to be aware of his surroundings and struck her. The blow of the impact caused her to briefly lose consciousness. She also suffered a fractured collarbone and separation of her AC joint.

The pedestrian was unconscious just after the accident, so she had no memory of the accident or how it occurred. Therefore, the police officers could not collect information to accurately tell her side of the story. The police wrote a report based almost entirely on the at-fault driver’s statement, which was obviously self-serving. The police report came out AGAINST the pedestrian, alleging that she was at fault for the accident.

The pedestrian was really worried about the bad police report and her mounting medical bills. She therefore reached out to the Oakland personal injury attorneys at Sally Morin Law for help. Sally and her team immediately tracked down an independent witness to pivot the case in the pedestrian's favor. Sally and team then diligently investigated the at-fault driver for all available insurance coverage and personal assets to see what they were capable of paying for the client’s injuries. Sadly, the driver only carried $50,000 of liability insurance and had no assets. With this news, the pedestrian feared that she would owe thousands of dollars in medical bills, not to mention be stuck with the bill for legal costs and fees. Fortunately, Sally and her team were able to negotiate the client’s medical bills down significantly so that she could end her case with money-in-hand after payment of all medical and legal costs in her case.

At Sally Morin Law, our goal is to only help those pedestrian accident victims who really need our help!

That's why we focus only on helping those victims who are hard-working, have a positive outlook on life, and want to return to their jobs and spending time with family as quickly as possible.
