Hoverboard injuries

Hoverboard Risks, Injuries, and Rules You Should Know

Hoverboards are a lot of fun, but they’re also among the most hazardous products you can buy. They’re so dangerous, the Consumer Product Safety Commission (CPSC) maintains a site dedicated to hoverboard safety, injuries, and recalls.

Just take a look at hoverboard fail videos on YouTube and you’ll see what we mean. Nobody seems to be able to stand up on a hoverboard for more than a few seconds!

There are all kinds of ways a hoverboard can hurt you. Here at Sally Morin Personal Injury Lawyers, we handle personal injury accidents involving hoverboard lacerations, head trauma, back injuries, burns, explosions, hoverboard vs. vehicle accidents, and more.

Hoverboards Cause Painful Personal Injuries

Hoverboards have been popular for years and were the hottest holiday gift of 2015. Since then, the ever-increasing number of hoverboards in the world has led to an ever-increasing number of hoverboard accidents.

Kids often have trouble balancing on hoverboards because the devices zip around fast and can easily jerk out from under a child’s feet. Adults also have trouble balancing on a such a small board that looks like a skateboard but moves like a supercharged scooter.

Hoverboards commonly cause injuries like:

  • Hand and finger injuries
  • Broken arms and legs
  • Cuts, bruises, abrasions, and lacerations
  • Back, neck, and spine injuries
  • Head injuries including traumatic brain injuries
  • Eye and facial injuries from impacts
  • Burns from fires and explosions

Hoverboard Rules Here in California

California was one of the first states in the nation to enact hoverboard laws shortly after the devices were introduced in the marketplace. By 2016, the California legislature had passed California Assembly Bill 604 describing hoverboards as electrically motorized boards that are prohibited from certain areas.

Hoverboard riders under age 16 are prohibited from using most of California’s public walkways, sidewalks, bikeways, and bicycle paths. Riders are forbidden from exceeding 15 mph.

An update to the law in 2018 made hoverboards street legal in certain situations, including roadways where the speed limit is lower than 35 mph. Helmets and reflectors are required, and it’s illegal to ride a hoverboard when too drunk, drugged, or distracted to ride safely.

Is the Manufacturer Responsible for Hoverboard Accidents?

Product liability lawsuits over hoverboards are plentiful. There have been dozens of recalls due to fires and explosions, plus persistent safety issues involving hoverboard designs and programming errors that have led to severe injuries.

Generally speaking, it will be difficult to hold a hoverboard manufacturer responsible for an accident that occurred when the device was doing what it was designed to do. If you slipped and fell on your own while using a hoverboard as intended, that’s probably on you.

However, if the hoverboard malfunctioned, caught fire, or was assembled improperly, you may have a strong case for accident compensation. In these instances, the hoverboard isn’t performing as designed and was posing a risk to you.

For example, there was a case in Petaluma, California where a child’s hoverboard exploded indoors and sent fiery balls of debris flying through the family’s home. And just weeks before, a similar hoverboard exploded in a nearby Santa Rosa home. The CPSC investigated both hoverboards for defects in the devices’ batteries and chargers.

What would you do if a hoverboard posed a danger to your family? What if you or your child suffered a severe injury from a hazardous hoverboard?

After a personal injury from a hoverboard, we’ll offer you a free initial consultation so you can weigh your options. You may have multiple paths to compensation for your injuries and other losses because a hoverbard caused you harm.
