Hoverboard Rules Here in California

California was one of the first states in the nation to enact hoverboard laws shortly after the devices were introduced in the marketplace. By 2016, the California legislature had passed California Assembly Bill 604 describing hoverboards as electrically motorized boards that are prohibited from certain areas.

Hoverboard riders under age 16 are prohibited from using most of California’s public walkways, sidewalks, bikeways, and bicycle paths. Riders are forbidden from exceeding 15 mph.

An update to the law in 2018 made hoverboards street legal in certain situations, including roadways where the speed limit is lower than 35 mph. Helmets and reflectors are required, and it’s illegal to ride a hoverboard when too drunk, drugged, or distracted to ride safely.

Is the Manufacturer Responsible for Hoverboard Accidents?

Product liability lawsuits over hoverboards are plentiful. There have been dozens of recalls due to fires and explosions, plus persistent safety issues involving hoverboard designs and programming errors that have led to severe injuries.

Generally speaking, it will be difficult to hold a hoverboard manufacturer responsible for an accident that occurred when the device was doing what it was designed to do. If you slipped and fell on your own while using a hoverboard as intended, that’s probably on you.

However, if the hoverboard malfunctioned, caught fire, or was assembled improperly, you may have a strong case for accident compensation. In these instances, the hoverboard isn’t performing as designed and was posing a risk to you.

And just weeks before, a similar hoverboard exploded in a nearby Santa Rosa home. The CPSC investigated both hoverboards for defects in the devices’ batteries and chargers.
