They collect premiums from us all year long, and then when it comes time to pay out on a claim, their goal is to pay as little as possible so they can keep profits up and shareholders happy. With that in mind, you must go into negotiating your personal injury case with reasonable expectations.

There are many factors that you need to consider when setting your expectations for settlement in your personal injury case. The most important are:

  • ​Severity of the accident.
  • ​Cost of medical care.
  • ​Reasonableness of medical care.
  • ​Amount and reasonableness of any loss of earnings.
  • ​The particular circumstances of your pain and suffering.
  • ​Which insurance company you are dealing with.
  • ​Which insurance claims adjuster you are dealing with.
  • ​The rapport you may or may not have established with the adjuster.
  • ​The quality of the supporting documentation you provide with your demand.
  • ​Whether or not you are represented by an attorney.
  • ​The reputation and track record of that attorney.
  • ​How quickly you might want or need the settlement money.
  • ​How educated or savvy you are.

The list goes on and on.
