I just spent the last 8 months working with a team of caring, compassionate, relatable women for my personal injury claim. Brief background: I was hit by a car while riding my bike to work. The driver pulled out of a parallel parking space without looking and was completely at fault. Initially, he and the others in the car were very concerned, but ghosted us afterwards and made up a story in order to not take on the blame. I ended up needing surgery and costs mounted, so I sought legal advice. After much research, I settled on Sally Morin Law. The team at this law firm is invested and responsive in a very personable way. I specifically worked with Carmen and Annie. Carmen took the lead and she answered every email, text, and annoying question my husband and I sent her way. She wrote a detailed demand letter that personalized my case and thoroughly explained the impact the accident had on my life, my children's lives, and my husband's life. In the end, our own insurance policy covered the claim to the fullest amount. Additionally, Carmen was able to negotiate the medical lien to $0, and my husband received a separate smaller amount for loss of consortium. We are more than happy with the results as it’s way beyond what we expected, and completely life changing. We didn't proceed with the case thinking we would have the outcome we did, and almost didn't pursue the case. However, after spending my own money on copays, days off from work, take out, uber rides, babysitters, and special equipment, it just didn't feel right not to seek help and I am so glad that I did! I highly recommend Sally Morin Law!

Accidents Happen in San Francisco

Bicycle and Tesla Collide on San Francisco’s Market Street

At about 8:20 a.m. on a clear Wednesday morning in September, San Francisco police arrived at the scene of a bicycle vs. vehicle accident on Market Street. Medics were already treating the bicyclist for injuries.

The vehicle involved in the collision was a black Tesla Model 3 and its driver was from Ontario, Canada. He explained to the officer that he frequently travels between Ontario and California. His Tesla had a minor scuff on its fender.

The Tesla driver told police that he’d been driving westbound on Market Street toward Diamond Street and was attempting to make a left turn when he felt the bicyclist impact his right rear fender. He pulled to the side of the road.

The bicyclist had been riding a white specialized bike, which the officer observed now had a cracked front wheel frame. The cyclist told the officer that he had been traveling eastbound on Market Street, had the green light, and the Tesla driver turned left and stopped in the intersection without yielding to him, so his bicycle hit the Tesla.

The cyclist went to the emergency room by ambulance for further evaluation of his injuries. Following an investigation, the officer determined that the vehicle made an unsafe left turn under California Vehicle Code 21801(a) and cited him for the violation.

What would you do if you were injured in a collision like this? It’s your right under California law to demand compensation from the person who hurt you.

Illegal Left Turn Causes Motorcycle Accident With Injuries in San Francisco

Just after 7 p.m. on a Wednesday evening in San Francisco, a police officer arrived at an accident scene to find one damaged car, one driver, and one damaged motorcycle. EMTs had already transported the motorcyclist to the hospital with injuries.

The officer interviewed the vehicle driver, who said she’d been in the right lane of westbound 16th street in her 1998 Pontiac Sunfire and attempted to move into the left lane. She didn’t see the motorcyclist and “that’s when he hit my car.”

Next, the officer went to the hospital to interview the motorcyclist, who was being treated for left leg injuries and a broken collarbone. He told the officer he’d been traveling straight in the left lane of 16th Street on his 1992 Ducati Desmo when the other driver turned left in front of him from the right lane. He braked, but there was nowhere to go and his motorcycle collided with the car.

After additional investigation including examining the roadway, looking at physical evidence, and speaking to witnesses, the officer concluded that the Pontiac driver caused the accident by pulling left in front of the motorcyclist. The officer cited the Pontiac driver under CVC 22100(b) for making a prohibited left turn from the right lane.

What if you were injured in a motorcycle accident like this? It’s a horrible situation, but here’s some good news:  You have the right under California law to demand compensation from the driver who hurt you.

Driver Flings a Cyclist Onto the Hood of His Car in San Francisco Crash

Imagine the shock of being hit by a car while riding your bicycle in San Francisco. One of these bicycle vs. car accidents happened at Webster Street and Lombard Street just after 7 p.m. on an October evening.

The bicyclist told police she was riding her Trek Antelope road bike slowly northbound on Webster toward Lombard, following three vehicles that had already entered the intersection before her. She said she saw the other driver approaching from the opposite direction, then he suddenly turned left directly in front of her.

The vehicle, a blue 2015 Chevy Trax, had been traveling southbound on Webster Street. Its driver said the light was green and he signaled a left turn but didn’t see the bicyclist until he made the turn and struck her bike. The impact sent her flying up onto the hood of his vehicle.

The bicyclist had injuries including a large laceration to her forehead and knee pain. After interviewing both parties and examining the bicycle, vehicle, and roadway, the officer issued a citation to the Chevy Trax driver under CVC 21801(a) for failing to yield to other traffic while turning at an intersection.

After a traumatic road collision like this, turn to Sally Morin Personal Injury Lawyers to seek high-dollar compensation for your injuries, bike damage, and other costs. We’ll offer you a free consultation because we’re here to help injured cyclists like you!

What if I’m Not Sure Whether I Have a Case?

It’s common to wonder whether you have a case for compensation after a serious accident where you were injured. The answer isn’t simple.

In San Francisco, if you are injured by another individual, corporation, or government entity, you are legally entitled to collect monetary compensation in an amount suitable to cover your expenses and damages – however, compensation is never guaranteed.

These are the main ways you can pursue compensation:

To secure full compensation, you must demonstrate the legitimacy of your injuries, show that the accident is the cause of them, prove that you had medical costs and other hardships, and show that a certain person was the at-fault party. Your attorney can help you secure and maximize your compensation by making a case for your financial losses and damages related to your injuries.

What Kind of Compensation Could I Recover?

If you’re wondering what kind of compensation you could receive in your San Francisco case, keep in mind that most injury cases are not punitive in nature and will cover only your demonstrable damages. There are two main types of damages:

  • Special damages: This includes things like car loss, property damage, medical bills, and lost earnings.
  • General damages: This is a broad category that is harder to define and may include pain, inconvenience, distress, loss of hobbies, and loss of a lifestyle with your loved ones.

Talk to your lawyer about the losses you have suffered that are changing your life and shaking up your finances. The better case you can put together, the better chance you have at receiving high-value compensation.
