As I’ve talked about in other videos, there are two types of damages: special and general, and three types of special damages you can recover: property damages, medical damages and loss of earnings damages. These discussions have been focused on collecting for past damages (damages that you have already incurred.)

Today, I explain FUTURE DAMAGES (damages that have not occurred, but are expected to occur in the future): Someone who is anticipated to incur special and/or general damages in the future may be compensated for those damages.

To recover damages for future medical expenses you must prove the reasonable cost of reasonably necessary medical care that you are reasonably certain to need in the future. To recover damages for future lost earnings, you must prove the amount of earnings you will be reasonably certain to lose in the future as a result of the injury.

To recover for future pain and suffering, you must prove that you are reasonably certain to suffer that harm in the future. This may sound simple enough, but in order to prove these future damages, you will likely have to hire medical economic and psychological experts to provide their testimony about the reasonableness and likelihood of these future damages.
