Will Uber Eats Insurance Cover My Injuries after a Car Accident?

Car accidents are challenging enough to deal with, but what happens when a delivery driver hits you? More specifically, what happens when you are in an accident with an Uber Eats driver?

Uber Eats has revolutionized food delivery. On any given day, hundreds, potentially thousands of Uber Eats drivers are on the roads delivering meals to customers. And while this has made food delivery quite convenient, it does add to traffic congestion — which is already a significant issue in California.

While dealing with car accident injuries after a collision with an Uber Eats driver is certainly not something you’d want, the good news is that your injuries could be covered by Uber Eats insurance. It simply depends on the situation and who was at fault.

If you are involved in an accident with an Uber Eats driver in California, our legal team at Sally Morin Personal Injury Lawyers can help. We’ve helped numerous clients with their California car accident claims, ensuring they walk away with the compensation they deserve.

Does Uber Eats Require Insurance?

Uber Eats drivers are not considered official employees of Uber. Instead, they are hired on a contractual basis. As such, they drive their own vehicles, which means they are required by the state and by Uber to carry car insurance coverage.

If an Uber Eats driver is not on the clock and logged into the app, you would file a claim against their personal insurance after an accident. This process would be the same as it would for any other driver with which you are involved in an accident.

If, however, the Uber Eats driver is actively working, then Uber Eats’ third-party insurance will apply.

Does Uber Eats Cover Accidents?

If the Uber Eats driver is at fault for the accident and your injuries, then yes, Uber Eats insurance would cover the accident. However, you can only blame Uber Eats with proof that their driver was, in fact, the one at fault.

As with any accident, if you intend to file a claim for injuries and other potential damages, you carry the burden of having to prove that another party acted negligently and caused you harm. So with an Uber Eats accident, you could have your injuries covered, but you would need to work with an attorney to build a strong case against the Uber Eats driver that proves they were at fault.

Additionally, there are two separate third-party insurance policies that Uber Eats carries, and which one applies will depend on the specific circumstances regarding the Uber Eats driver’s activity on the app.

How Uber Eats insurance coverage works:

  1. If the Uber Eats driver is logged into the app and is waiting to receive a request to pick up an order when the accident happens:

Uber Eats insurance provides the following coverage –

    • $50,000 per person for bodily injury
    • $100,000 per accident for bodily injury
    • $25,000 per accident for property damage
  1. If the Uber Eats driver has officially accepted an order request and is on their way to pick it up or drop it off when the accident happens:

Uber Eats insurance provides the following coverage –

    • $1 million per accident

Again, these policies only apply if the Uber Eats driver is actively working and logged into the app. If the driver is not working, then their personal auto insurance coverage would apply if they are at fault.

Filing Uber Eats Accident Claims

If the Uber Eats driver is at fault for the accident when they were working, you have the right to file a claim against them to recover compensation for the damages you have suffered. However, as mentioned previously, you will still need to provide evidence to prove that the Uber Eats driver was at fault.

As Uber Eats is a major company, they have their own experienced legal team defending them, so you will need to work with an attorney if you want to win your case against them. When you work with a lawyer, they can help investigate the accident, obtain the necessary evidence to prove fault and ensure you are awarded the total and fair settlement you deserve.

Such evidence that can help your lawyer build a strong case against Uber Eats can include the following:

  • Photos or videos from the scene of the accident
  • Video surveillance footage
  • Dashcam footage
  • Police reports
  • Eye witness statements

Documents showing you were treated for injuries can also help you build a solid case to ensure you get the full amount you are owed. So it’s important to see a doctor after the accident and keep copies of all your bills, invoices, and any other paperwork relating to the treatment of your injuries.
