  1. If the Uber Eats driver has officially accepted an order request and is on their way to pick it up or drop it off when the accident happens:

           Uber Eats insurance provides the following coverage – 

    • $1 million per accident

Again, these policies only apply if the Uber Eats driver is actively working and logged into the app. If the driver is not working, then their personal auto insurance coverage would apply if they are at fault.

If the Uber Eats driver is at fault for the accident when they were working, you have the right to file a claim against them to recover compensation for the damages you have suffered.
