Here’s something you might not realize about Amazon Flex drivers. They’re independent contractors, not Amazon delivery drivers. Similar to Uber drivers, they use an app to make deliveries while driving around in their personal vehicles.

See the problem? They’re not Amazon employees. So after an accident, Amazon will try to deny responsibility and tell you to take it up with the driver.

But that’s not where the story ends. You can get a lawyer and show them you’re not backing down and you’re going to assertively pursue a claim for your damages.

After your accident, start by taking down the driver’s name, phone number, license plate number, plus any other information they’re willing to give you. Work with the police to get a copy of the police report, which is usually required for an insurance claim.

Get emergency medical care at the scene of the accident and/or see a doctor as soon as possible for proper treatment of your injuries. Without documented injuries that can be directly attributed to the accident, you might have trouble getting insurance to pay your bills.

When it comes to proving a claim against an Amazon Flex driver, you’ll have the most success with covering your costs if you follow a two-step approach. Start by pursuing the individual driver’s auto insurance carrier, then ask Amazon to cover any remaining amount.

Here’s how it might work in a typical accident. Let’s say you have $50,000 in costs from the accident. California has a mandated state minimum of $15,000 in insurance coverage, so imagine that the Amazon Flex driver’s insurance covers that amount and leaves you with $35,000 remaining.

Now you can approach Amazon about covering that extra $35,000. Amazon Flex provides coverage for up to $1 million in liability insurance, plus $50,000 for comprehensive/collision coverage and $1 million in uninsured motorist coverage.

Before they pay, they’ll request proof that you already pursued the driver’s insurance carrier and reached the policy limit. They’ll also want you to prove their driver was in the process of delivering an Amazon package at the time of the accident.

If you’re making an Amazon Flex claim, you have to prove that the driver was in the process of actually delivering packages for Amazon if you want to hold Amazon liable.

Like I discussed before, if you’re in an accident with an Amazon Flex delivery person and your accident exceeds the value of their private insurance policy. Let’s say they carry an insurance policy of the California state minimum of 15,000, and your accident is worth 50,000. Then you’re going to want to make sure you can prove that they were in the process of delivering packages for Amazon in order to get Amazon on the hook for anything over the driver’s personal insurance of 15,000.

In order to do that, you would do what we do in our Uber cases, for example, and check the status of the driver’s app. The Amazon Flex app will have record of when this person logged in, when they logged out, whether they were in transit, whether they had already just dropped off a package and were done.

That’s really how you do it. You don’t always get that information right upfront, so I would encourage you to contact a personal injury attorney who’s had experience with these types of cases so that they can dig in for you and get the app history and the information you need to prove that they were indeed working for Amazon at the time of the accident.
