Sally Morin continues discussing the five most important things you must do when negotiating a settlement in your personal injury case.

Now that you’ve established rapport with the adjuster and set the boundaries for who controls the information in your case, you need to make sure that you are getting good quality medical care that is reasonable and necessary.

You want to be sure to seek care from well-reputed healthcare providers who provide quality services. Insurance companies will not pay for care that they find to be “shady” or of no value in helping you recover from your injuries. You must restrict the treatment for which you seek to be compensated to that which is “reasonably necessary.”

This means treatment that is reasonable in cost and medically necessary because of the accident. So, you certainly can be compensated for the $90 massage you received because your orthopedic surgeon recommended it to break up scar tissue caused by the accident, but you will not be compensated for a $250 massage you got at a fancy spa because you felt like relaxing.

You also want the treatment to be very soon after the accident. If you seek treatment a few days after the accident, it can be assumed that this is a reasonable delay in seeking treatment. However, if you wait till a few months after the accident, you will likely not be compensated for that treatment due to the “unreasonable” delay.

Finally, you want to make sure treatment is not excessive. For example, if you receive 50 chiropractic adjustments for a minor injury, you will have trouble getting paid for that, but if you receive a dozen acupuncture treatments for pain documented at the emergency room, you should have no trouble getting that covered.

So, to recap – “Reasonable and Necessary” medical care is well-reputed, quality, reasonably necessary, close in time, and not excessive. The bottom line is that if the information you are presenting is reasonable, the adjuster will be more apt to give you a fair settlement.

Accident Client

“Last March, my partner was struck by a vehicle while crossing the street. During this difficult time of healing, we knew that bills were going to pile up and his was going to be a long process. After looking at multiple law firms, we knew that Sally Morin Personal Injury Lawyers was going to be the best place to work with. Lauren and her team were patient, supportive and caring during his difficult time. His schedule was always busy with work and doctor appointments that his main source of communication was through email. Lauren and her team made it to where he didn’t have to worry about anything but just sending over the paper work he got from the hospital, and other bill collectors involving his incident and they worried about the rest.

Because of all their help my partner Aaron, was able to heal with less worries on his shoulders. By end of December, everything was settled and we were pleased with the results. I’d like to give a huge thank you to Lauren & the Sally Morin team. If you’re looking for a law firm for your incident, I’d definitely look at this law firm.”
